Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of being struck by
vehicles used around
the clock basis around the flammables that had serious mechanical defects.
The vehicles are Ford
F350 trucks modified into fuel hydrant trucks. Ford F150 pickup trucks and
a Chevrolet
Beauville Passenger Van.
a). Fuel Hydrant truck #4268 was in-operation without any backup lights,
on or about 08/29/94.
b). Fuel Hydrant truck #2317 was in-operation without backup lights or
parking lights, on or
about 08/29/94.
c). Ford F350 trucks #3112 & 603 were in with bald and worn tires, on or
about 08/29/94.
d). Ford F350 truck #4267 was in use without turn signal lights (front or
back), bald left front
tire and no right rear brake light, on or about 08/29/94.
e). Chevrolet Beauville Passenger Van #4063 was in use without operating
backup lights, on or
about 08/29/94.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to develop and initiate a "Driver Preventive Maintenance Program" as
outlined in "Motor Fleet
Safety Manual", by the National Safety Council. On vehicles used around
the clock this
inspection should be done prior to each shift with a post trip/use
inspection. Part of the program
includes checking of, fluid levels, clutch or transmission operation,
brakes, horn, headlights,
parking lights, brake lights, turn signal lights, marker lights, (if
applicable), tires, exhaust
system, fresh damage or mechanical deficiencies, check and fill out
"Vehicle Defect Report."
If pre-existing defects still exist note then again and bring it to the
attention
of the person(s) in
charge of initiating the equipment.
