Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to being
struck by a falling vehicle due to lack of maintenance and repair of
automo-
tive lifts in the shop area as evidenced by inoperative and/or missing
automatic safety locks on latches and leaking seals:
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to repair or replace defective equipment and establish
inspection and maintenance procedures to ensure continued safe operation
of
the lifts as recommended by the lift manufacturer, and required by
ANSI/ALI
B153.1-1990, American National Standard for Automotive Lifts - Safety
Requirements for the Construction, Care, and Use.
