Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of infection by Bloodborne Pathogens when in the course of their work, they come in contact with blood and body fluids. These employees are not being informed regarding safe work practices to follow when said exposures occur; including but not limited to the following: Recognintion of rasks and other activities that may involve exposure to blood and other potentially infectious materal. An explanation of the use of equipment and work practices designed to prevent or reduce exposure, such as; sharps handling and disposal, correct use and disposal of personal protective equipment, and proper disposal of contaminated waste. Information regarding the Hepatitis B vaccine and the offering of the vaccine at no cost to the employee. An explanation of the procedures to follow in an exposure incident occurs including past exposure evaluation and follow-up.
