Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the improper use of logging equipment: Worksite - On or about 4/6/98, an accident occurred injuring an employee at R & R Lumber Company, Carmel, Maine involving a SERCO 8000 logging loader with a 1/4 bypass grapple used as a material lifting device to relieve the pressure created by the 4 railroad track sections used to construct a steel structural support system for the foundation and new log deck floor in order to slide a piece of 2 1/2" x 2 1/2" x12' 1" steel square stock into place between the foundation and the 4 rail sections. Among other methods, one feasible and acceptable method to correct this hazard is to use proper material handling/lifting devices/equipment, such as but not limited to a mobile crane with the proper lifting and attaching devices/equipment.
