Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a  place  of  employment  which
were free from recognized hazards that were causing or likely to  cause
death or serious physical harm to  employees  in  that  employees  were
exposed to being struck by a falling load or  crane  component  due  to
failure of a crane component on a portal tower crane  approximately  50
years old.
Among other methods,  one feasible and acceptable abatement  method  to
correct this hazard is to establish a preventative maintenance  program
and periodic inspection program to include all  components,   including
rope inspection and to establish a safe capacity  for  each  hoist  and
develop a rated load chart (ref. ANSI B30.4):
Yard Area Adjacent to #1 Marine Railway - In the following
instances the American Crane and Hoist Portal Tower Crane
was not in compliance with Section 5(a)(1) of the OSH Act
of 1970 in that:
a) The crane had no load ratings.
b) No inspection program had been instituted for the
crane.
c) Crane modifications had been done without approval
by a recognized authority.
d) Crane controls were illegible.
e) The crane did not have a load rating chart.
f) No preventative maintenance program had been developed
for the crane.

exposed to being struck by a moving vehicle:
Among other methods,  one feasible and acceptable abatement  method  to
correct this hazard is to repair the defective brakes as  indicated  by
the manufacturers manual.
Yard Area - The international harvester boom truck was not
in compliance with Section 5(a)(1) of the OSH Act of 1970
in that the brakes were inoperative:
a) 1957 Intl. Harvester boom trucks; three axle, with
1000 gallon water tank.
