Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to the hazard of becoming infected with bloodborne
pathogens through possible direct contact with blood or other
body fluids:

Company wide: The employer did not ensure that all employees who
had direct contact with blood or body fluids, including but not
limited to agency medical technicians and ambulance attendants
were formally and actively trained in precautionary measures,
epidemiology, modes of transmission and prevention of bloodborne
pathogen infections including but not limited to human
immunodefficiency virus and Hepatitis type B.

Among other methods. one feasible and acceptable abatement
method to this hazard would be the implementation of a worker
safety training program which includes the risks, severity and
the personal protective equipment associated with prevention.
