Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: JOBSITE: ON OR ABOUT 4/6/93, THE TELSTA T-40C AERIAL LIFT BUCKET TRUCK WAS IN MOTION/TRAVELLING WHILE AN EMPLOYEE WAS IN THE BUCKET, EXPOSING THE EMPLOYEE TO THE HAZARD OF FALLING. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD IS: 1. LOWER THE BOOM BACK TO THE HOME POSITION BEFORE TRAVELLING. 2. TRAVEL WITHIN THE SPEED THAT WAS PREDETERMINED AND RECOMMENDED BY THE MANUFACTURER. 3. FOLLOW AND COMPLY WITH THE MANUFACTURER'S OPERATING INSTRUCTIONS AND ANSI A92.2. 4. UTILIZE OTHER SAFE AND EFFECTIVE MEANS.
