Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to: The hazard of being trapped inside the freezer without a
means of egress, in the event the door is shut while an employee is
inside.  As the National Sanitation foundation Standard Number 7, Food
Service Refrigerators and Storage Freezers states:  Doors shall have a
mechanism to permit opening from the inside, even when locked.
a)   AT THE ESTABLISHMENT - A WALK-IN STORAGE FREEZER WAS NOT
PROVIDED WITH A MECHANISM WHICH WOULD ENABLE AN EMPLOYEE
TO OPEN THE DOOR FROM THE INSIDE.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO
CORRECT THIS HAZARD IS TO INSTALL A PROPER FUNCTIONING LATCH MECHANISM
WHICH WOULD PROVIDE AN EMPLOYEE A MEANS OF EGRESS
