Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
Hazards of being crushed, struck or pinned by falling pieces of
concrete
and corroded reinforcing steel bars.  Yonkers raceway stable area ramps
R1-R5, Barn Area, Yonkers Raceway, 810 Yonkers Ave.,Yonkers, NY
(a) Six months preceeding 5/27/93: In that employees were exposed to
the hazards of being crushed, struck, or pinned under the falling
pieces of concrete and corroded steel reinforcing bars which have
had their structural integrity compromised.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABAATEMENT METHOD TO CORRECT THIS HAZARD IS ....
1) Prohibit employees from using all (5) five elevated structures.
No employees shall be allowed to walkover or under the elevated
damaged structures.
2) Perform the required corrective measures to restore the structural
integrity of raceway stable area ramps R1-R5, in the barn area as
recommended by a registered professional structural engineer.
Recommendations
will be in accordance with engineering practices and
ACI (American Concrete Institute) 318-89, building code requirements
for reinforced concrete.
