Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Onor about 2/22/95, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and/or explosion while walking or working in the area of the boiler room in that: a- The Old Boiler Room - On or about 2/22/95, a licensed person on watch did not give constant attention to high pressure boiler #2 as required by section 12:90-3.10(b) of the New Jersey Boiler, Pressure Vessels and Refrigeration Code 12:90. An acceptable method of abatement to correct this hazard is that a licensed person is within constant sight or sound of a high pressure boiler in operation.
