Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a moving elevator car: a)On or about 3/11/99 an Elevator Mechanic working at 175 Remsen Street, Brooklyn, in elevator pit #1 was exposed to this hazard due to insufficient safety marking on the Hoistway Pit Stop Switch. The toggle type stop switch did not have the "Stop" position labelled with the word "Stop" to provide clear indication of which position of the toggle switch will make the elevator stop and which position will make the car run up and down within the elevator shaft. A feasible method to correct this hazard is to provide Hoistway Stop Switches conspicuously and permanently marked "Stop" and which shall indicate the stop and run positions as required by Industry Standard ANSI A17.3 "Safety Code for Existing Elevators"; Section 2.3.3 and section 3.10.4(e) (3).

Section 5(a)(1) on the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by moving elevator equipment due to inadequate light in the elevator hoistway and pit: a)Worksite; 175 Remsen Street, Brooklyn: An employee working on the underside of car #1 was exposed to electric hazards and hazard of moving equipment due to a nonworking "Worklight" mounted on the underside of Elevator Car #1 and a non working Elevator Pit Light located in elevator pit #1. On or about 3/11/99 an Elevator Mechanic working in the hoistway under Elevator Car #1 at 175 Remsen Street, Brooklyn was exposed to this hazard due to a nonworking"Worklight" mounted on the underside of Elevator Car #1 and also to a non working Elevator Pit Light located on the wall of the pit. One feasible and acceptable method of correcting this hazard is to ensure that these worklights are maintained in a working condition during the monthly service visits for this elevator equipment. Adequate worklight in elevator hoistways is a safety requirement recognized and listed in the Elevator Employees' Safety Manual, Chapter 5, P. 74.
