Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the likelihood of falling out of or being thrown
from the lift
truck:
a)At the establishment: The employer did not install seat belts to prevent
workers from
falling out of or being thrown from forklift trucks (TCM and Yale) they
were
operating in the warehouses; on or about 06/02/99.
ABATEMENT NOTE: Among others, one feasible and acceptable method to
eliminate or
materially reduce this hazard would be to require that the operator wear
the required seat belt
during truck operation.  Reference: ASME/ANSI B56.1D-1992, 7.39(a)(b).
Pepsi Cola Bottling Company of New York, Inc. was previously cited for a
violation
of this
Occupational Safety and Health Standard or its equivalent standard,
Section 5(a)(1)of the
Occupational Safety and Health Act of 1970, which was contained in OSHA
Inspection
Number 109893792, Citation Number 01, Item Number 001, issued on 02/12/99,
with a
Final Order Date 03/23/99.
ABATEMENT VERIFICATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE
WITH 29 CFR 1903.19.   FAILURE TO COMPLY MAY RESULT IN AN
ADDITIONAL PENALTY OF $1000.00.L
