Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by the dumbwaiter:
a)Employees were exposed to the hazard of being struck by the dumbwaiter
car at
the basement while working in or operating the dumbwaiter where doors were
missing, on or about September 10, 1999.
b)The employer failed to insure that the dumbwaiter was equipped with the
safeguards for dumbwaiters. The safeguards were required by the building
code
R.S. 18.1 of the city of New York. The requirements for safety devices on
dumbwaiters are reflected in ASME A-17.3, 6.1.3, 1996 standard.
ABATEMENT NOTE: Among others, one feasible and acceptable method to
eliminate or to
materially reduce this hazard is to ensure that the machine doors are
closed
while it was being
