Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
being crushed between Dumbwaiter car and wall:
a) Basement level, Blue Star Supermarket, 40-10 Main Street, Flushing
NY. - On 3/9/90 - Atlas Dumbwaiter FDO - 500 installed at location
was permitted to operate with its hoistway door open (basement level)
without engagement of electrical and mechanical interlock and
contacts.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is: to return all mechanical (keeper) interlocks
to doors, rewire electrical contacts and the safety system for the
basement level interlock, to insure that the dumbwaiter car will only
operate up or down when both car hoistway doors are in the closed
position.
