General-duty citation text
Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling off an unstable and unsecured raised work platform without guard rails placed on the forks of an industrial lift truck: a) Curcio Facility: An employee was observed riding an unguarded platform on the raised forks of an industrial lift truck on or about 12/8/93. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to establish and enforce those procedures, such as: that stipulated by the American National Standards Institute Inc. ANSI B56.1-1975 edition, Safety Standards for Powered Industrial Trucks, Part II Section #427 and Part III Section #513 addressing the safety of personnel working on raised platforms.
