Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being infected by tuberculosis through repeated prolonged indoor air contact with patients who may be infected with tuberculosis: a) Emloyees including, but not limited, to the staff physician, intake counselor, billing clerks, dispensing nurses, HIV counselor and TB counselor/nurse who treat and/or interact with active TB patients were not provided the Mantoux Test at six-month intervals on or about 1/12/93.
