Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to death and crushing hazards due to the unplanned collapse of an overhead structure due to the severe corrosion and deterioration of the base supports: a) Iron and Transportation Division, Transportation Department. North End of the Ore Yard. Stacker Conveyor. The supporting foundation structure for the overhead conveyor was severly deteriorated in that the tip of the concrete foundation piers had concrete missing, exposing vertical and horizontal reinforcing rods and base support bolts, which were also severely damaged by corrosion, observed August 8, 1989. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to repair structural damage to the foundation to comply with its original design specifications.
