Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to health hazards from inhalation and dermal contact with toxic substances (dry powder cement, gasoline, and fuel oils) and from asphyxiation during entry and work in confined spaces(s): a) Appropriate space entry procedures were not implemented for protyection of employee(s) at the Interstate Tank Center in Bath, Pennsylvania, during entry into transporation bulk tank(s) for the purpose of cleaning, welding and other repair activities of damaged tank(s). This employer was previously cited for a violation of this Occupation- al Safety and Health Standard or its equivalent standard which was contained in OSHA Inspection Number 110048188, (FTA), (S9965-87), Citation Number 1, Item Number 1, issued on 9/20/90. One feasible and acceptable abatement method is the utilization and enforcement of Interstate Tank's "Rules and Procedures for Interstate Tank Center", which was submitted to and received by OSHA on 8/2/91. (It should be noted that reinspection by OSHA on 8/6/91 revealed that: 1) The system of entry permits was not being used and 2) There was no supplied air respirator available for emergency rescue).
