Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
falling injuries from an improperly constructed and utilized forklift
personnel elevating platform. The following conditions contributed to
the existence of this hazard:
A) Personnel platform was elevated on industrial truck forks without
being secured to the forks or upright, on or about September 18,
1990.
B) Personnel platform was elevated on industrial truck forks without
platform perimeter guarding midrails, on or about September 18, 1990.
Feasible and acceptable abatement methods among others include:
1) Chains or clamps should be provided to secure the personnel platform
to the industrial truck lifting carriage or forks (Instance A).
2) The existing personnel platform guardrails should be fitted with
midrails or a body belt with lanyard or deceleration device should
be worn by the person on the platform (Instance B).
