Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause deat or serious physical harm to employees in that employees were exposed to: a) The hazard of oxygen deficiency and a lack of rescue procedures during repair of rollers inside of the becks in the light and dark dye areas on or about June 14, 1990. Several feasible and useful methods to correct the hazard are: 1) Assure that the employee entering the tank had been trained in proper tank entry procedures. 2) Assure that the atmosphere inside of the tanks are tested for oxygen deficiency prior to entry. 3) Assure that an outside standby observer is made available with adequate adequate for rescue in an emergency. 4) Assure that the outside standby observer is trained in tank entry and rescue procedure. 5) Assure that an entry permit is provided prior to tank entry. Among other methods, one feasible and acceptable abatement method would be to follow the procedures for confined space entry described in ANSI 2 117.1-1977 and NIOSH Publication Criteria for Recommended Standard... Walking in Confined Spaces.
