Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On September 12, 1990, the Caterpillar 225 BLC Trac Hoe in use at the 200 Block S.W. 6 Street was being operated without any type of swing radius guarding, exposing employees to the hazard of being struck by the rotating super structure. One feasible method of abatement would be to use ropes or ribbons to barricade the swing radius.
