General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Safe access to the vessel's crane cab was not provided. The fore crane of the "North Express" at Berth 68, Port of Miami, did not have foot holds/ladders from the catwalk to the crane's rotating superstructure. The employee could fall up to 20 feet onto the coaming or into the water. Reference: 1917.45(f)(4) and ILO "Safety and Health in Dock Work", 1979, Section 3.7. Among other methods, one feasible and acceptable abatement method to correct this hazard is to extend the ladder of foot holds, so that rungs would be no more than 12 inches (+2 inches) apart and install alignment bars on the port side of the vessel to permit proper centering of the crane.
