Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about August 28, 1992, at the Spanish River site, employee was exposed to fall hazard of 11 feet while standing on "I" beam platform directing the installation of sheet pile. In the alternative 29 CFR 1926.28(a). Among other methods of abatement one is: 1. To provide safety belts and lanyards with a secure place to tie off; 2. Scaffolds with railings and planked out work platform.
