Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about January 27, 1993, at 63 Place, City of Royal Palm Beach, Florida, the "Packmaster-Mack refuse truck Lic. #M57735U, was backing out of a hard packed dirt road and ran over the "dump man", who was riding on the passenger side rear step. Among other methods one feasible and acceptable abatement method 1) While backing long distances, the "dump man" should be inside the cab. 2) While backing, the "dump man" could walk the vehicle out to the turn area while being continuously in the operator's view. 3) When the "dump man" is not visable to the operator, backing should discontinue. 4) In continuous, repeated backing situations, procedures should be established.
