Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Hazards associated with entry and work in confined space such as cleanning inside 4,000 gallon chemical mixing tank without testing for potential oxygen deficiency and air contaiminants (e.g., formaldehyde); and without the benefit of forced ventilation which would help ensure sufficient dilution of any air contaminants and adequate oxygen content
