Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck due to unplanned collaspe: (a) At the Courtyards Condominium Apartments, numbers 462, 472 and 488 the floor area of balconys/decks were not braced or shored to prevent an unplanned collaspe, where there was evidence that structural damage had occurred to main support members before permitting employees to enter upon and/or under the balconys/decks to be demolished.
