Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of fall to lower level: a) Warehouse, Dock Area #10-Employees operating Crown High Rider #534 are not protected by guardrails or tether. Lifts do not have railing or a tether capable of preventing falls great than 6 feet. Among other methods, one feasible and acceptable method is to provide tethers having 5 feet of slack measured beneath the point of attachment to the operator.
