Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.The hazard of being struck or punctured by projectiles from polyvinyl chloride (PVC) pipe having a line pressure of over 100psig, which was used to transport compressed air for the pumps and pneumatic tools. Fragmentation of the pipe can occur because of fatigue cause by cold contents, ambient temperatures or non-compatibility of pipe with its contents, etc. Among others feasible and acceptable abatement methods to correct this hazard would be: 1.An Acrylonitrile, Butadiene Styrene (ABS) pipe could be substituted. 2.Polyvinyl chloride pipe (PVC) that is completely enclosed in a conduit or casing of sufficient strength to provide protection from external damage and deterioration. 3.Metal piping could be substituted.
