Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential overexposures to ammonia in emergency situations: a.On or about March 3, 1998, the employer had not provided the employees with Self Contained Breathing Apparatus (SCBAs) and a backup SCBA immediately outside or in the vicinity of the exit for the New Machine Room, or Area #2 of the ammonia refrigeration system, exposing employees to respiratory distress. b.On or about March 3, 1998, the employer had not provided the employees with Self Contained Breathing Apparatus (SCBAs) and a backup SCBA immediately outside or in the vicinity of the exit for the Inside Blast Room, or Area #3 of the ammonia refrigeration system, exposing employees to respiratory distress. Among other methods, two feasible means of abatement would be: 1.Maintain SCBAs in storage containers hung on the wall outside the entry ways for the New Machine Room and the Inside Blast Room. 2.Maintain a storage lockers containing SCBAs by the entry ways for the New Machine Room and the Inside Blast Room. ABATEMENT CERTIFICATION IS REQUIREDATION
