Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential overexposure to ammonia in an emergency: a.On or about July 9, 1998, the employer had not provided the employees with Self Contained Breathing Apparatus (SCBAs) and a backup SCBA immediately outside or in the vicinity of the exit for Machine Room #2 of the ammonia refrigeration system, exposing employees to respiratory distress. b.On or about July 9, 1998, the employer had not provided the employees with Self Contained Breathing Apparatus (SCBAs) and a backup SCBA immediately outside or in the vicinity of the exit for Machine Room #1 of the ammonia refrigeration system, exposing employees to respiratory distress. c.On or about July 9, 1998, the employer had not provided the employees with Self Contained Breathing Apparatus (SCBAs) and a backup SCBA immediately outside or in the vicinity of the exit for Ice Machine Room above the Ice House of the ammonia refrigeration system, exposing employees to respiratory distress. Among other methods, two feasible means of abatement would be: 1.Maintain SCBAs in storage containers hung on the wall outside the entry ways for the Machine Rooms. 2.Maintain a storage locker containing SCBAs by the exits of the Machine Rooms. ABATEMENT VERIFICATION IS REQUIRED
