Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being infected with HBV and/or HIV: (a) Employees performing embalming services on or about May 31, 1991, were exposed to the hazard of being infected with HBV and/or HIV through possible direct contact with blood and/or body fluids. Feasible abatement methods for reducing this hazard include but are not limited to: 1. Establishment of a Hepatitis B vaccination policy that offers Hepatitis B vaccinations (at no cost to the employee) to all exposed personnel (embalmer and assistants). 2. Establishment of a post exposure evaluation and follow-up program that includes antibody and/or antigen testing, counseling for exposed employees, illness reporting, and meausres the employees can take to prevent future exposure (i.e. Universal precautions as outlined by CDC).
