Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of bloodborne infection:

(a) The employer's infection control program did not address all
areas of concern.  These areas include, but are not limited to:
%%
(1) Tags or other equally effective means of identification (e.g.,
red bagging) shall be used when containing articles contaminated
with potentially infectious materials, including contaminated
disposable items.

(2) Solid or Liquid waste, refuge and garbage shall be removed
in such a way to avoid creating a menace to health and disposed of
in accordance with institutional policies for disposal of
infectious waste.

(3)  Follow-up procedures after possible exposure to HIV or HBV.

(4) Education and training of employees.

It is recommended that the newly promulgated OSHA bloodborne
pathogen standard, 29 CFR 1910.1030 published in the December
6, 1992 Federal Register (copy enclosed) to be used as a guideline
for your compliance with this citation until the respective
effective dates of March 6, 1992, and May 5, 1992, mentioned at
subpart (i) of the enplosed standard.
