Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by equipment when malfunctioning equipment
was not taken out
of service:
a.At the Sandpiper Village Development, located in Destin, FL., employees
were
required to operate hydraulic ramps on a "lowboy" trailer with a known
malfunctioning hydraulic system, on or about February 11, 1997, without
first
removing the trailer from service for repairs.
b.At the Sandpiper Village Development, located in Destin, Fl., sufficient
work
practice controls that could eliminate an employee from being struck by a
falling
hydraulic ramp were not implemented.  For example, employees were allowed
to stand directly under the ramp.
Among other methods, the following are feasible and acceptable abatement
methods to
correct this hazard:
1.Immediately remove malfunctioning equipment from service until repairs
have been completed.
2.Establish and ensure that employees stay outside the perimeter of a 10-
foot zone around the ramps at all times when the hydraulic ramps are
being operated. Ensure that employee(s) operating the ramps always stand
to the side of the ramp.
ABATEMENT CERTIFICATION IS NOT REQUIRED
