Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by pipe fragments. a.On or about September 17, 1997, the employer had a line pressure of up to 110 pounds per square inch gauge (psig) in polyvinyl chloride pipe (PVC) used to transport compressed air for the pneumatic tools and spraying operations. Fragmentation of the pipe can occur because of fatigue caused by cold contents, and or ambient temperatures and non- compatibility of pipe with its contents, etc. Among other methods, 3 feasible means of abatement would be: 1.An Acrylonitrite, Butadiene Styrene (ABS) pipe could be used. 2.Polyvinyl chloride pipe (PVC) with that is completely enclosed in a conduit or casing of sufficient strength to provide protection from external damage and deterioration. 3.Metal piping could be used.
