SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO: A) ON OR ABOUT JANUARY 22, 1991, EMPLOYEES AT THE ICA CONSTRUCTION SITE WERE NOT PROVIDED A SAFEWORK PLACE FREE FROM RECOGNIZED HAZARDS IN THAT THE EMPLOYEES WERE EXPOSED TO FALLS AND BEING STRUCK BY THE WHEELS ON A FORD BACKHOE WHILE RIDING ON THE STEPS AND FENDER. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO PROHIBIT EMPLOYEES FROM RIDING ON EQUIPMENT. REFERENCE: A.N .S.I. B56-1-1969.
