Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
Employees were exposed to bruises, contusions, fractures, and/or
death from the hazard(s) involved with a malfunctioning hoist
located in the receiving area.  The Robbins & Myers 2 1/2 ton
beam hoist was being operated with a malfunctioning hoist swtich
which caused the hoist to ascend or descent unpredictably.
Feasible and acceptable means of abatement of this hazard are
to establish an inspection and maintenance program which includes
but is not limited to:
1.  Frequent inspection(s) for defects and a determination
made as to whether a safety hazard exists.
2.  Establish and maintain records of all inspections made.
3.  Repair or replace the defective switch before returning
the hoist to service.
