Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees have a possibility of being infected with Hepatitis B virus and/or Human Immunodeficiency virus when recapping contaminated needles. Among other methods, a feasible and acceptable abatement method to correct this hazard is: 1) Develop written procedures for the disposal of cotnaminated needles or sharps, to be included in written exposure conttrol plan. 2) Inform employees on the disposal procedures and the incident exposure hazard of recapping contaminated needles. 3) An explanation of the procedure to follow if an exposure incident occurs, including the method of reporting the incident and the medical follow-up that will be made available.
