Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards associated with falling due to improper counterweights improperly placed on the inboard end of outriggers suspending a swing stage scaffold from a roof. The actual weight of the material had not been determined, the material was flowable and not positively affixed to the outriggers to prevent movement. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and use counter weights which are made to fit the outriggers and are of a known and marked weight and positively attaching the sufficient amount of weights to the outriggers. The responsible employee shall be trained in the requirements of the system and how to determine the required amount of weight for the load to assure at least a 4 to 1 safety factor for the swing stage.
