Section 5(A)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Merchants 4802-K, Rig 12:  An employee, engaged as a driller on a Wilson
75, Winchmobile,
Rig number 12, was asked by the toolpusher to climb the derrick to see
about a problem they
were encountering in scoping the upper portion of the derrick.  The
driller climbed the ladder
approximately fifty-five feet without a climbing device or safety belt and
lanyard to use as a tie
off.  The derrick experienced a settling of the upper portion and the
shaking of the derrick
dislodged the driller from the ladder where he fell and was fatally
injured.
One feasible and accepted method of abatement would be to install another
climbing device in
the derrick to prevent someone from climbing the structure without fall
protection.
