Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: PVC pipe was used for the distribution of compressed air in the Fabrication Building, the one inch line was located about 10 feet above floor level and had 1.2 inch pipe drape along the north and west walls, the line had approximately 100 psi. PVC pipe is not designed or intended for use as compressed air distribution lines because it can shatter from external impact or surges of the compressed air creating flying pieces of plastic shrapnel.
