On November 19,1990, the Occupational Safety and Health Administration,
United States
Department of Labor, General Motors Corporation and the United Automobile
Workers of
America entered into an agreement (hereinafter "Agreement") settling
citations issued by
OSHA to GM facilities for violations of Section 5(a)(1) of the
Occupational Safety and
Health Act of 1970, OSHRC Docket No. 90-410 and 90-919.  GM agreed to
settle the
matters and to abate the cited conditions by instituting a corporate-wide
program to seek out
and correct similar hazards in other establishments, and to implement a
comprehensive
program relating to ergonomic hazards found in those establishments.  The
Agreement
became a final order of the Occupational Safety and Health Review
Commission.
In monitoring GM's performance under the Agreement, OSHA has determined
that GM
failed to abate and comply with various provisions of the agreement in
good faith and/or
certain provisions were not being reasonably addressed at the General
Motors MCD, 2525
East Abram St., Arlington, TX 76010 facility as follows:
a)5.3,  Employee Education and Training, Page 15:
Salaried employees (supervisors) were not trained according to the
Agreement, which
required that production and maintenance employees, including immediate
and general
supervisors, receive awareness training by March 16, 1993.  In addition,
newly hired
employees did not receive training within 15 days as required by 5.3.1.
b)4.4,  Implementations of Corrective Measures, Page 11.
The employer did not make a good faith effort to abate identified
ergonomic hazards
within six months of completion of the job analysis.  The status of many
jobs was not
documented, including reasons for delays beyond the six month period
established in
this paragraph of the Agreement.
