Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did nto furnish employment and a place of employment whick were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
The employer did not protect his employees from the recognized
hazards of suffocation when entering feed tanks to clean, maintain
and report amount of stored grain inside the feed tanks (bin).
Employee's were entering confined space, such as bins which were
approximately eight (8) feet diamater by 26 feet in depth. This
procedure required the employee to tie himself off at the top with
a 5/8" hemp rope. A harness and/or body belt with lifeline was not
used. An employee was not stationed on the outside, nor were air
samples taken for 02 deficiency prior to entering the bin. This
condition exposed the employee to a hazard of falling into the grain
bin and being covered up as well as being overcome by oxygen
deficient atmosphere.
One feasible and recognized method of abatement would be, but not
limited, to a bin entry procedure as recognized by industry which
contain the elements of bin entry procedures, Lockout/Tagout program,
emergency action plan and a hot work permit.
