Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) At this establishment, basement level; lower section of the freight
elevator floor gate
was modified with a fabricated metal hinged section(s), measuring a total
height of (29")
twenty-nine inches that was added onto the existing wood section of the
gate on the
bottom of the hoist-way entrance. The gate addition was added on to
eliminate the floor
opening hazard, but was not equipped with hoistway interlocks on the
vertical outside
gate to disable the freight elevator from operating.
While ultimate responsibility for correcting the hazard rests with the
employer, given his/her
superior knowledge of the work place, feasible and acceptable methods to
correct
this hazard,
among others, are:
1. Follow guidelines listed in American Standards Institute (ANSI) A17.1
2004 - Safety Code
for Elevators. Section 110 - Protection of Hoistway-Landing Openings.
2. Follow guidelines listed in American Standards Institute (ANSI) A17.1
2004 - Safety Code
for Elevators. Section 111 - Hoistway-Door Locking Devices, Car Door or
Gate Electric
Contacts, Hoistway Access Switches, and Elevator Parking Devices.
3. Follow guidelines listed in American Standards Institute (ANSI) A17.3
2004 - Safety Code
For Existing Elevators and Escalators. Section 4.7 Operating Devices and
Control Equipment,
paragraph 4.7.4 Electrical Protective Devices.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements
or monitoring results, and photographs or videos which you believe will be
helpful.  The
abatement certification sheet is enclosed with the citations(s).
