Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to slips/trips and stepping into floor holes:
a)  On or about June 6, 2005 and at times prior Timpas Feedyard LLC did
not ensure
that employees were protected from slips/trips and holes in
walking/working surfaces.
1.  Grates over the grain dump areas were missing pipes leaving openings
that
could be stepped through.
2.  Grain was allowed to build up in piles by augers causing slippery
areas to
walk through.
3.  Holes in the floor of the cooking area were improperly covered or not
covered
at all.
4.  Holes in the scale table were improperly covered or not covered at all.
5.  Holes and poorly supported metal decking on the roof near the auger
exposed
the employees to trip hazards.
Among other methods, one feasible and acceptable method of abatement to
correct this hazard
is:
a)  Install covers over the holes in a proper manner, evaluate and repair
the roof area
where the employees have to walk, and develop and maintain a house keeping
plan for the areas
near augers.

emergency medical treatment
on site:
a)  On or about June 6, 2005 and at times prior Timpas Feedyard LLC did
not ensure
that employees were protected from emergency hazards.
1.  The feedyard first aid kits were not evaluated, stocked, and
maintained.
2.  No first aid responders were trained to administer first aid as needed.
Among other methods, one feasible and acceptable method of abatement to
correct this hazard
is:
a)  Perform an evaluation of the necessary first aid supplies, stock the
kits as needed, and
train and designate an employee to be the first aid responder.

were exposed to ladder hazards:
a)  On or about June 6, 2005 and at times prior Timpas Feedyard LLC did
not ensure
that employees were protected from ladder hazards.
1.  Rungs of some job made ladders were less than 3/4 inch diameter, #4;1/2
inch rebar was used.
2.  All welding on the ladders did not conform to "Code for Welding in
Building
Construction" (AWSD1.0-1966).
3.  The distance from the rungs to the nearest permanent object in back of
the
ladder was not at least 7 inches.
4.  Bent rails and rungs were not repaired or replaced.
5.  Cages or wells were not provided on all ladders that required them.
6.  Landing platforms were not provide at proper elevations depending on
the
ladders.
7.  Ladders were not inspected and maintained on a regular basis.
8.  Permanent ladders were not properly attached to the structure.
Among other methods, one feasible and acceptable method of abatement to
correct this hazard
is:
a)  A person competent in ladder design and construction needs to do an
inspection of
the plant ladders.  The deficiencies need to be corrected and the
employees trained to
inspect the ladders regularly.

were exposed to electrical hazards due to improper installation and use of
electrical equipment:
a) On or about June 6, 2005 and at times prior Timpas Feedyard LLC did not
ensure that
employees were protected from electrical hazards in the following
instances:
1.  Intrinsically safe wiring and lighting systems were not maintained and
repaired
to keep the electrical systems isolated/safe in the grain handling and
feed mixing
areas.
2.  Cords were improperly spliced in the cooker room and the hospital area.
3.  Extension cords were used in lieu of permanent wiring systems in the
cooking
room, the feed mixing area, and the hospital.
4.  Panel boxes in the electrical room did not have covers, exposing live
conductors.
5.  The boiler controls were missing a cover and had strain relief
problems.
6.  The high power feed lines crossing the roof of the feedmill forced the
employees to step over them to do work on the roof auger system.
Among other methods, one feasible and acceptable method of abatement to
correct this hazard
is:
a)  An examination of the plant's electrical system needs to be done by a
qualified
electrical contractor and the wiring systems brought back into compliance
with the NEC
and CFR standards.

a)  Establishing a house keeping program that addresses the frequency and
methods
determined best to reduce accumulations of fugitive dust.

roof had no fall protection provided.
2.  Employees doing maintenance work from the bucket of a front end loader
were not protected from falls.
Among other methods, one feasible and acceptable method of abatement to
correct this hazard
is:
a)  Guardrails or a fall arrest system could be installed along the roof
line where the
employees work on the auger.  Ladders, scaffold, or manlift basket could
be used for the
operations where the loader bucket is used now.
