General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 16, 1993, and at times prior to that date, employees utilizing the freight elevator were exposed to the hazard of serious injury or crushing by the moving freight elevator due to the lack of a car gate to protect the operator. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to: 1. Install a vertical or horizontal opening car gate that would conform to ANSI A17.1-1971. 2. Allow employees to load the freight elevator only, send the elevator unoccupied, and employees on other floors unload the freight elevator. This process would eliminate the need for employees to ride the freight elevator.
