Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about January 8, 1992, and at times prior to, employees working at the Federal Beef Processors facility, located on Stockyard Road, West Fargo, North Dakota, were exposed to the hazard of being crushed underneath moving freight elevator cars or having body parts injured from contact with moving elevator components, or falling into elevator hoistways when the elevator car was not at an upper floor landing because of the following conditions: (a) In the northeast corner of the Offal Packing Room, the hoistway opening for the freight elevator used to transport boxes from the Dry Storage Room was not equipped with a hoistway door to prevent employees from entering the hoistway enclosure when the elevator car was not at the ground floor level. (b) On the north wall of the west Packoff Station and Boning Department loadout area, the hoistway opening for the freight elevator used to transport combo-bins and boxes from the Dry Storage Room was not equipped with a hoistway door to prevent employees from entering the hoistway enclosure when the elevator car was not at the ground floor level and the sides of the hoistway frame were not fully enclosed throughout their height. (c) In the southwest corner of the basement Processing and Boneshine Department, the hoistway door was capable of being opened when the hook elevator car was not at the landing and the hoistway door did not extend the full width of the opening from the floor level to the top of the opening and the sides of the hoistway were not fully enclosed throughout their height. (d) On the north end of the second floor Dry Storage area, the hoistway door for the freight elevator used to serve the loadout area was not provided with an interlocking device to prevent the door from being opened when the elevator car was not at the landing, exposing employees to a fall hazard of approximately 15 feet. (e) In the second floor Laundry/Trolley Wash room, the hoistway door for the trolley freight elevator did not enclose the entire hoistway opening when the elevator car was not at the landing. (f) In the northeast corner of the second floor Box Storage room, the hoistway door for the freight elevator was not provided with an interlocking device to prevent the door from being opened when the elevator car was not at the landing, exposing employees to a fall hazard of approximately 15 feet, and the hoistway door did not fully enclose the entire hoistway opening and did not prevent body parts from passing through the door openings. Among other methods, one feasible and acceptable abatement method to correct the hazards as recommended by the American National Standards Institute (ANSI), Safety Code for Dumbwaiter Elevators, ANSI A17.1-1971, Part VII, would include: (1) Installation of positive mechanical locking device and electric contact interlocks that would prevent hoistway doors from being opened when the elevator car is not at the landing. (2) Fully enclosing all hoistways on all sides with fire-resistive material throughout their entire height. (3) Installation of fire-resistive door assemblies without perforations at all hoistway landing openings.
