General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) At the Ladish Malting Company facility in Spiritwood, North Dakota, employees working throughout the malthouse, barley elevator, and malt elevator were exposed to the hazard of entrapment, smoke inhalation, burns and other associated injuries in the event of fire and concurrent power failure affecting the general lighting equipment, as those employees attempted to evacuate the facilities in darkened conditions. Among other methods, one feasible and acceptable abatement method to correct this hazard would include the installation of emergency lighting equipment installed at exits and means of egress paths as recommended by NFPA Code 101, Section 28-2.9.1.
