Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
(a)An employee was exposed to a fall of 42 feet while
sealing and unsealing a bin for fumigation at Cargill
Grain.  The employee used a 38 foot long rope tied to
the body harness dee ring with a bowline knot which is
not equivalent to connectors that are drop forged,
pressed, or formed steel.
(b)The employee used a 38 foot long rope tied to the
anchor point with a bowline knot which is not
equivalent to connectors that are drop forged, pressed,
or formed steel.
(c)The employee used a 38 foot long rope that did not
limit the free fall distance to less than 6 feet.
