Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling, rolling or swing trees: (a) The accident site up Forest Service Road 244 - On or about November 2, 1992 and at times prior thereto, employee(s) not covered by a comprehensive safety and health program were exposed to hazardous work conditions such as, but not limited to, working down hill of, and within the swing radius of, tree length logs being yarded up a 55 to 60 degree hill. Among other methods, one feasible and acceptable abatement method to correct this hazard is: (1) A written employee safety and health program including a policy statement for the company and safety and health rules and procedures to be incorporated into site operations for each job description. (2) Regular documented safety meetings and/or training sessions to instruct all employees on safe work practices and the applicable safety and health regulations. %% (3) New employees indoctrination including formal and onthe-job instructions. (4) Written step-by-step procedures to be followed by the trainer and trainee during new employee training period. This should include procedures to be followed by the trainer and trainee during on-the-job training. (5) Documented periodic on site follow-up by management on new employee training to ensure adequate and proper training is being given and understood. (6) Documented frequent and regular inspections of the job site work practices, materials and equipment. (7) Development of an enforcement program to ensure work rules and safety and health regulations are complied with. This should include documentation of any disciplinary actions and/or corrective measures taken. (8) Documentation of all employee safety and health training. %%
