Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hoist failure: (a) East end of deck: The Wright 1 ton underslung hoist was not inspected and maintained in accordance with American National Standards Institute Safety Code for Overhead hoists (Underhung) (ANSI B30.16-1987). NOTE: See appropriate note below: 1. The hoist was not inspected on a frequent basis (at least monthly) by a designated competent person covering the items listed in section 16-2.1.2. See section 16-2.1.1(b)(1). 2. The hoist was not inspected on a periodic basis(at least annually) by a designated competent person covering the items listed in section 16-2.1.3. See section 16-2.1.1(b)(2). 3. The hoist was not load tested after the hoist suspension beam had been altered by welding an extension on the south end of the beam. See section 16-2.2.2(b)(2). (b) West end of deck: The CM 2 ton underslung hoist was not inspected and maintained in accordance with American National Standards Institute Safety Code for Overhead hoists (Underhung) (ANSI B30.16-1987). NOTE: See appropriate note below: 1. The hoist was not inspected on a frequent basis (at least monthly) by a designated competent person covering the items listed in section 16-2.1.2. See section 16-2.1.1(b)(1). 2. The hoist was not inspected on a periodic basis(at least annually) by a designated competent person covering the items listed in section 16-2.1.3. See section 16-2.1.1(b)(2). (c) East end of Utility: The Yale 1 and 1/2 ton underslung hoist was not inspected and maintained in accordance with American National Standards Institute Safety Code for Overhead hoists (Underhung) (ANSI B30.16-1987). NOTE: See appropriate note below: 1. The hoist was not inspected on a frequent basis (at least monthly) by a designated competent person covering the items listed in section 16-2.1.2. See section 16-2.1.1(b)(1). 2. The hoist was not inspected on a periodic basis(at least annually) by a designated competent person covering the items listed in section 16-2.1.3. See section 16-2.1.1(b)(2). 3. The hoist was not load tested after the hoist suspension beam had been altered by welding an extension on the south end of the beam. See section 16-2.2.2(b)(2). (d) Finish: The Coffing 1 ton underslung hoist was not inspected, maintained and used in accordance with American National Standards Institute Safety Code for Overhead hoists (Underhung) (ANSI B30.16-1987). NOTE: See appropriate note below: 1. The hoist was not inspected on a frequent basis (at least monthly) by a designated competent person covering the items listed in section 16-2.1.2. See section 16-2.1.1(b)(1). 2. The hoist was not inspected on a periodic basis(at least annually) by a designated competent person covering the items listed in section 16-2.1.3. See section 16-2.1.1(b)(2). 3. The hoist was not load tested after the hoist suspension beam had been altered by welding an extension on the south end of the beam. See section 16-2.2.2(b)(2). 4. The hoist was periodically lifting weights in excess of the rated load. See section 16-3.1.2(h). Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. Contract with a qualified person to load test and conduct periodic inspections of the hoists. 2. Train an employee or employees to conduct frequent inspections of the hoists. 3. Ensure employees do not lift loads in excess of the hoists rated capacity.
